Terms of Use
This is the agreement between you and Proclaim Advisors about using Brass Key. It is written to be read. If any of it seems unclear or unfair, write to hello@brasskey.app and say so.
You can use the app
We give you permission to use Brass Key on the Apple devices you own or control, for as long as you like, for anything lawful. That permission is personal to you and cannot be sold or transferred, but otherwise there is nothing to sign and nothing to renew.
Your photos are yours
We claim no ownership of, and no rights over, anything you put in the app. We could not exercise them if we did: your photos never reach us.
You are responsible for what you store. Do not use Brass Key for anything illegal.
What we do not do
- We do not have your passcode, and we cannot reset it.
- We cannot see, recover or restore your photos. There is no copy anywhere but your device.
- We cannot get your photos back if you forget your passcode, lose your device, or erase your vault.
This is the design, not a shortcoming. Any of those would require someone other than you to be able to open your vault. Please keep your passcode somewhere safe.
Please do not
- Take the app apart to copy how it works, or try to defeat its security or its subscription.
- Rent it out, resell it, or pass it off as your own.
- Use it to break the law or to harm somebody.
The exception: you may do whatever the law where you live says you may do regardless of an agreement like this one. We are not trying to sign away your legal rights, and where this agreement and your local law disagree, your local law wins.
The subscription
The app is free. A subscription adds unlimited albums and device-to-device syncing, and nothing else.
- Apple handles the payment, and Apple's terms apply to it.
- It renews automatically until you cancel.
- Cancel any time in iOS Settings ▸ your name ▸ Subscriptions. That is the only place a subscription can be canceled — we cannot do it for you.
- Canceling stops the next renewal. You keep the subscription until the end of the period you have paid for.
- Refunds are Apple's to give. Ask them, and tell us if something went wrong.
If your subscription ends, nothing is hidden, locked or deleted. Every album you made keeps working and everything already synced stays on both devices. You simply cannot create new albums beyond the free limit, and syncing pauses until you subscribe again.
If we change the price, Apple tells you before it takes effect and, for a large enough increase, will not renew you without your agreement.
No promises we cannot keep
We have built this carefully and we use it ourselves. But no software is perfect, and we cannot promise Brass Key will never lose data, never crash, or work on every device and every version of iOS. It is provided as it is.
So please keep a backup of anything you cannot afford to lose. Pairing a second device is the way to do that without a copy leaving your control.
If something goes badly wrong
If we are ever at fault, what you can recover from us is limited to what you paid for the app in the twelve months before — which for most people is a couple of pounds. We are not liable for lost photos, lost time, or anything that follows on from a problem with the app.
Some countries do not allow a limit like that. If yours does not, it does not apply to you, and nothing here removes a right you have by law.
Ending it
You can stop using Brass Key whenever you like. Deleting the app deletes the vault with it.
We can end this agreement if you seriously break it — for example by attacking the app's security or using it to commit a crime. Since the app runs entirely on your device, that mostly means we stop supporting you rather than reaching in and switching anything off.
Apple's part in this
Apple is not a party to this agreement and is not responsible for Brass Key. Apple does not provide support for it. If the app does not work as it should, that is our responsibility, and Apple's only obligation is to refund the purchase price if their own terms require it. Apple may enforce these terms as a third-party beneficiary — that is a condition of selling on the App Store, and it is the one piece of boilerplate here that we cannot write in our own words.
You also confirm you are not in a country subject to a US trade embargo and are not on a US restricted-parties list. That one is Apple's requirement too.
Changes
If these terms change, the new version goes here with a new date. Continuing to use the app means the new version applies. If a change does not suit you, stop using the app and cancel any subscription.
The legal bit
This agreement is governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules, and you may bring a claim wherever the law entitles you to. If a court finds any part of this unenforceable, the rest still stands.
